Waiver of Liability and Hold Harmless Agreement

This Waiver of Liability and Hold Harmless Agreement (the "Agreement") is entered into on _{sign_date}___, between Kaizen Submission Grappling ("the Gym") and the undersigned participant or guardian of a minor participant, hereinafter referred to as "the Participant."

Release of Liability:

In consideration of being allowed to participate in activities, programs, and use the facilities provided by the Gym, the Participant hereby acknowledges and agrees to the following:

1. Assumption of Risk: The Participant acknowledges that participating in activities at the Gym, including but not limited to grappling, martial arts, fitness training, and the use of gym equipment, carries inherent risks of injury. These risks include, but are not limited to, sprains, strains, fractures, concussions, and other injuries. The Participant voluntarily assumes all such risks.
2. Release of Liability: The Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, releases the Gym, its owners, employees, instructors, and affiliates from any and all liability for personal injury, death, property damage, or any other loss or damage that may arise from participation in Gym activities, whether caused by the negligence of the Gym or otherwise.
3. No Guarantees: The Participant acknowledges that the Gym makes no guarantees or representations regarding the outcome or results of participating in its programs or using its facilities.

Hold Harmless Agreement:

The Participant agrees to indemnify and hold the Gym, its owners, employees, instructors, and affiliates harmless from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney's fees, arising out of or related to the Participant's participation in Gym activities.

Rules and Regulations:

The Participant agrees to abide by all rules and regulations of the Gym and follow the instructions of Gym staff and instructors. Failure to do so may result in the termination of membership or participation.

Medical Consent:

The Participant or their legal guardian hereby consents to the provision of medical treatment or care deemed necessary by a licensed medical professional in the event of injury or illness during Gym activities.

Photographic and Likeness Release:

The Participant grants the Gym the right to use their likeness in photographs, video recordings, or other media for promotional purposes without compensation.

Acknowledgment:

The Participant acknowledges that they have read this Agreement, understand its contents, and agree to be bound by its terms. The Participant further acknowledges that this Agreement is a legally binding contract and voluntarily signs it.
